Client Story: How we secured compensation for breach of medical records

Our Client

In 2021, our client had his second Covid Phfizer vaccine and became unwell with a migraine 2 days later. He was still suffering 14 months on with severe migraines and had been back and forth to his GP for help.

Because of the severity of his migraines, he was no longer able to work and went on sick leave in May 2022, but fortunately, he had an insurance policy in place, and he was able to cover his loss of earnings.

His insurance company asked him if they could seek information from his GP to look at his options. He had signed an authority allowing his GP to release information that solely related to his migraines. Unfortunately, his GP surgery instead sent the insurance company his entire medical file which contained private and sensitive information that he did not want anyone, including his insurance company to see.

Upon seeing some of this information, the insurance company decided to stop all payments to him which at the time was his only source of income.
